An Idea To Make India A “corruption-free” Country

In India, there is a lot of agitation about the issues of corruption. Last year has seen lot of corruption cases coming to the light in the country. There has been a serious and major anti-corruption movement by Gandhian Anna Hazare. Millions of people have participated in the anti-corruption movement held in New Delhi. The movement raised several questions about the intention, legal procedure and provision provided in the Constitution of India to a common man of this country against the act of corruption in the public and private domains.

Seeing that a common man in India has to face the

evil of corruption at many avenues, it is desirable to have a permanent solution to this issue of corruption. However, the solution to this issue should have full support, and be an important part of, the Constitution of India because, in the Independent India, nothing is supreme than this living document; individuals who organize and run this country draw their powers and privileges from the Constitution; the Supreme Court of India decides the limits, defines the provisions and parts of the Constitution from time to time; and the common men totally depend of the Constitution for their political living, i.e., for securing their fundamental rights and rest of the political rights.

There is a very interesting and powerful provision in the Constitution. It is called the power to amend it, i.e., incorporate changes to the existing laws and provisions and add the new ones according to the demand of the situation and need of the hour in the Constitution. For example, see the following preamble to the Constitution of India:

“WE, THE PEOPLE OF INDIA, having solemnly resolved to constitute India into a SOVEREIGN SOCIALIST SECULAR DEMOCRATIC REPUBLIC and to secure to all its citizens:
JUSTICE, social, economic and political;
LIBERTY worship;
EQUALITY of status and of opportunity;
and to promote among them all
FRATERNITY assuring the dignity of the individual and the unity and integrity of the Nation;
IN OUR CONSTITUENT ASSEMBLY this twenty-sixth day of November, 1949, HEREBY ADOPT, ENACT AND GIVE TO OURSELVES THIS CONSTITUTION.”
In

the Preamble, terms “SOCIALIST and SECULAR” were added in 1976 after the Forty-second amendment made to the Constitution of India.

Considering the current scenario in the country, and witnessing the discloser of so many cases of corruption, the time has come to make another Forty-second-amendment-like change to the Constitution through which, we add a new term “CORRUPTION-FREE” to the Preamble to the Constitution. Thus, the new Preamble will read as follows:

“WE, THE PEOPLE OF INDIA, having solemnly resolved to constitute India into a SOVEREIGN SOCIALIST SECULAR DEMOCRATIC CORRUPTION-FREE REPUBLIC and to secure to all its citizens:
JUSTICE, social, economic and political;
LIBERTY worship;
EQUALITY of status and of opportunity;
and to promote among them all
FRATERNITY assuring the dignity of the individual and the unity and integrity of the Nation;
IN OUR CONSTITUENT ASSEMBLY this twenty-sixth day of November, 1949, HEREBY ADOPT, ENACT AND GIVE TO OURSELVES THIS CONSTITUTION.”
Since we are the practitioners of properties such as SOVEREIGN SOCIALIST SECULAR DEMOCRATIC and REPUBLIC, and of course we the masters of completely implementing these properties in our lives, it is not at all bad to think that soon we will incorporate the practice of making this country “CORRUPTION-FREE.” And since the Supreme Court has the power to define and implement these provisions successfully, as has been the case since independence, it will quickly acquire the ability to define, implement and sustain the ststus of a “CORRUPTION-FREE” environment in the country.

With this amendment, Indian constitution will acquire the status of being the first ever document in the word that would offer a “CORRUPTION-FREE” state to its citizens and India will become the first country in the world to do so.

Let’s gift ourselves this great, unique and above-all kind of a provision through an simple constitutional amendment.
